Terms of Travel Services

Provision of Travel Services

Limited Liability Company "AVIATION SYSTEM INTEGRAL SERVICE" (LLC "ASIS"), legal entity identification code 38396957, registered address: 19 Soborna Street, Sumy, 40000, Ukraine, represented by its Director Ihor Vsevolodovych Zbukarev, acting on the basis of the Company Charter, hereinafter referred to as the "Service Provider", offers individuals, legal entities and individual entrepreneurs (hereinafter referred to as "Customers") to order travel and/or related services by submitting an electronic request.

This Agreement constitutes a public offer and is published on the Service Provider's website at: https://aviasis.com.ua

Terms and Definitions

1.1 Offer

An offer of the Service Provider addressed to any individual, legal entity and/or individual entrepreneur in accordance with Article 641 of the Civil Code of Ukraine to conclude the Agreement on the terms set forth in this offer.

1.2 Acceptance

A response of the Customer to whom the offer is addressed regarding its acceptance. Acceptance shall be deemed to occur when the Customer submits an electronic request and/or makes payment. Acceptance must be complete and unconditional.

1.3 Customer

A user who has booked travel and/or related services via the Service Provider's website and paid for the booked service using one of the payment methods available on the website.

1.4 Travel and Related Services

Services including transportation, hotel accommodation, and other services not directly related to transportation and accommodation (including organization of visits to cultural, leisure and entertainment facilities, sale of souvenir products, etc.).

1.5 Website

The Service Provider's internet resource located at: https://aviasis.com.ua, which contains the Service Provider's offers regarding travel and related services and the terms for their provision.

Procedure for Concluding the Agreement

2.1

This Agreement is an offer to conclude an electronic contract. The Agreement is concluded by the Service Provider making the offer and the Customer accepting it.

2.2

The Service Provider offers to conclude this Agreement by publishing the offer on the Internet.

2.3

If the Customer agrees with the offer, they provide the Service Provider with confirmation of full and unconditional acceptance by: submitting an electronic request on the Website; paying for travel and/or related services; or confirming acceptance by sending a message to the Service Provider's email.

2.4

Acceptance of the public offer confirms the Customer's full and unconditional agreement to comply with the terms of the Agreement.

2.5

The Parties agree that the Customer may not withdraw from the offer once it has been accepted.

Subject of the Agreement

3.1

This Agreement regulates the legal relations arising between the Service Provider and the Customer in connection with the provision of travel and/or related services.

3.2

For the fee specified in the price list published on the Website, the Service Provider undertakes to provide the Customer with a set of travel and/or related services accepted by the Customer.

3.3

Under this Agreement, the Service Provider represents the Customer before third parties that directly provide travel and/or related services.

3.4

The services provided under this Agreement may be consumed both within Ukraine and abroad.

3.5

The direct providers of such services may include airlines, hotels, insurance companies and other tourism service providers. The Service Provider acts solely as an intermediary between the Customer and those service providers.

Ordering Procedure, Terms and Payment Conditions

4.1

After reviewing the information on the Website, the Customer may select any offered services and order them by completing an electronic request form.

4.2

During submission of the electronic request, the Customer must provide: surname, name and patronymic (as in the passport); date of birth; gender; mobile phone number.

4.3

The Customer confirms the accuracy of all data entered and assumes full responsibility for their accuracy and reliability.

4.4

Confirmation of the order is carried out by clicking the "Pay" button and after funds are credited to the Service Provider's account.

4.5

After confirming the order, the Customer is redirected to the payment page. Payment is made by bank transfer or bank card.

4.6

After payment, the system stores the message with service details and may send it to the Customer's email. The Customer must verify all data.

4.7

All financial settlements under this Agreement shall be made in Ukrainian hryvnia (UAH).

4.8

Funds paid, except for the Service Provider's agency remuneration, are considered transit funds to be transferred to direct service providers.

Rights and Obligations of the Parties

5.1 The Service Provider undertakes to:

  • Receive requests from the Customer through communication channels available on the Website;
  • Inform the Customer about transportation rules, tariffs, penalty conditions and other relevant information;
  • Ensure the reservation of services and organize their provision in accordance with this Agreement;
  • Promptly inform the Customer of any changes in flight conditions, accommodation, or tour program.

5.2 The Customer undertakes to:

  • Timely provide all documents and information necessary for the proper provision of services;
  • Pay for the services in accordance with the terms of this Agreement;
  • Arrive at the specified departure point at least two (2) hours before departure;
  • Inform the Service Provider about any changes or additions related to the services;
  • Comply with public order and the laws of the country of temporary stay;
  • Comply with internal regulations and fire safety rules at accommodation facilities;
  • Observe personal safety rules during travel;
  • Compensate for any damages caused by unlawful actions.

5.3 The Service Provider has the right to:

  • Receive complete and reliable information and documents from the Customer;
  • Retain actual expenses incurred in case the Customer cancels the Agreement before services are provided.

5.4 The Customer has the right to:

  • Request information from the Service Provider regarding the performance of this Agreement;
  • Receive necessary and reliable information in accordance with applicable consumer protection legislation.

Liability of the Parties

The Parties shall bear responsibility for failure to fulfill obligations in accordance with applicable Ukrainian legislation.

The Service Provider shall not be liable in the following cases:

  • Late, incomplete or incorrect payment for services;
  • Late modification or cancellation of the Customer's request;
  • Failure of the Customer or persons traveling to appear or late arrival for check-in;
  • Absence of a properly issued passport or required travel documents;
  • Removal of the Customer from a flight during customs or border control;
  • Loss or damage of the Customer's baggage;
  • Losses incurred due to cancellation of a flight by the carrier;
  • Discrepancies between services provided and the Customer's subjective expectations.

The Parties shall be released from liability for failure to perform obligations if such failure results from force majeure circumstances that directly affect the performance of the Agreement.

Dispute Resolution

7.1

For all matters not regulated by this Agreement, the Parties shall be guided by the current legislation of Ukraine.

7.2

The Parties shall endeavor to resolve any disputes arising from this Agreement through negotiations.

7.3

If disputes cannot be resolved through negotiations, they shall be submitted to the competent court of Ukraine.

Term of the Agreement

8.1

This Agreement enters into force from the moment of its conclusion and remains valid until the Parties fully fulfill their obligations.

8.2

The Service Provider has the right to unilaterally terminate this Agreement by notifying the Customer 14 days in advance via electronic communication.

8.3

The only legally valid version of this Agreement is the version published on the Website. Amendments become binding from the moment they are published.

8.4

The Parties confirm that they voluntarily enter into this Agreement and possess the legal capacity required for its conclusion.
